Welcome to Kodaga. The terms “Kodaga,” “we,” “us,” and “our” refer to the business operating kodaga.com.
These Terms of Service govern your access to and use of our website, store, products, features, and related services (collectively, the “Services”), together with the policies expressly referenced below.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services.
Please read these Terms carefully before using the Services or placing an order. By using the Services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue use.
Nothing in these Terms excludes, restricts, or replaces any consumer rights or other legal protections that cannot lawfully be waived.
To place an order, you must have the legal capacity to enter into a binding contract in your jurisdiction. A minor may use the Services only with appropriate permission and supervision from a parent or legal guardian.
You agree to provide accurate, current, and complete information, including your contact details, billing information, shipping address, and payment information.
If you create an account, you are responsible for keeping your login credentials secure and notifying us of suspected unauthorized access. You must not impersonate another person or use payment information without authorization.
We aim to describe and display our products accurately, including their features, materials, available sizes, and prices.
Colors and appearance may vary slightly depending on lighting, photography, and your device settings. This does not affect your rights if an item is defective, incorrect, or materially different from its description.
Please review the product description, size chart, and any fit notes before ordering. General size guides provide a reference; product-specific measurements or instructions take priority for the relevant item.
Product availability and size options may change. Changes to product descriptions do not remove our obligations concerning orders already accepted.
Submitting an order constitutes an offer to purchase the selected products at the checkout total.
An automated order confirmation acknowledges receipt of your order. We accept your order when we send a shipping confirmation or otherwise expressly confirm acceptance.
Orders are subject to product availability, payment authorization, and reasonable verification checks.
We may decline or cancel an order for legitimate reasons, including unavailable stock, an unresolved payment issue, a material listing error, suspected fraud, or a legal restriction.
If we cannot fulfill an order, we will notify you using the contact information supplied. If payment has already been collected, we will promptly refund the amount paid for the canceled order or affected items.
We will not substitute a materially different product or increase an accepted order’s price without your agreement.
Prices and checkout totals for our United States storefront are displayed in U.S. dollars (USD).
Applicable shipping charges, taxes, and discounts are shown at checkout before you complete your purchase. Please review the final total before submitting your order.
You authorize us and the relevant payment providers to process the payment required for your purchase using your selected payment method or approved installment arrangement.
Available payment methods are displayed at checkout. Additional information is provided in our Payment Terms page.
Shop Pay Installments, when offered, is subject to eligibility, approval, and the installment provider’s terms. Please review any payment schedule, interest, and other conditions before agreeing to a plan.
Your bank or payment provider may impose its own currency conversion or other account-related fees.
Promotions may have separate conditions, including eligibility requirements and expiration dates. Those conditions govern the specific offer but do not override mandatory consumer rights.
Price changes apply to future purchases and do not retrospectively change an accepted order.
If you need to change or cancel an order, contact info@kodaga.com as soon as possible with your order number and requested change.
We will check whether the order can still be changed or stopped. We cannot guarantee a change or cancellation once fulfillment is underway or the parcel has been dispatched.
If an order cannot be canceled, we will explain the available options. Your eligibility to request a return remains governed by our Return & Refund Policy and applicable law.
If we confirm a cancellation after payment has been collected, the applicable refund will be issued to the original payment method.
This section does not limit any cancellation or refund rights available for delayed or unfulfilled orders under applicable law.
Shipping destinations, processing times, estimated transit times, charges, and other delivery conditions are explained in our Shipping Policy and any applicable information presented before purchase.
Processing time and transit time are separate components of the estimated delivery period.
Please provide a complete and accurate delivery address. If you discover an error, contact us promptly. If a parcel has already been dispatched, an address change may not be possible.
If we cannot ship within the stated timeframe, we will notify you and provide any revised shipping information and cancellation or refund options required by applicable law. Where required, we will obtain your agreement before extending the shipment period.
If your parcel is delayed, appears lost, arrives damaged, or is marked delivered but cannot be located, please contact us. We will investigate with the carrier and arrange an appropriate resolution consistent with our policies and applicable law.
Handing a parcel to a carrier does not remove our obligations to you concerning fulfillment or your non-waivable consumer rights.
Our Return & Refund Policy forms part of these Terms.
For orders delivered within the United States:
Return or exchange requests may be made within 30 calendar days of delivery.
We accept returns for both defective and non-defective products.
Non-defective items must meet the condition requirements stated in our Return & Refund Policy.
Customers pay return postage for non-defective returns and arrange their own return labels.
Kodaga covers necessary return shipping costs for damaged, defective, or incorrect items.
We do not charge a restocking fee.
For eligible returns, we complete inspection and issue the refund within 3 calendar days of receiving the returned item.
Refunds are issued to the original payment method. The time for funds to appear depends on the bank or payment provider.

For complete instructions, refund calculations, exchange conditions, and exceptions required by law, please review the full Return & Refund Policy.
If these Terms conflict with that policy on return procedures, the more specific Return & Refund Policy applies, subject to mandatory consumer protections.
We may correct typographical errors or inaccurate information concerning products, prices, promotions, shipping, or availability.
If a material error affects your order, we will contact you and explain the available options. We will not require you to pay an increased price without your agreement.
If we cancel an affected order, amounts already paid for the canceled items will be refunded promptly.
Corrections do not permit us to avoid obligations concerning products already supplied or rights available under applicable law.
Website content, including text, graphics, logos, photographs, videos, and other materials, is owned by Kodaga or the relevant rights holders, or used under applicable permission or license.
You may access and use the Services for personal shopping and other lawful personal purposes.
Except as permitted by law or with appropriate permission, you must not reproduce, distribute, sell, or commercially exploit protected website content.
Purchasing a product does not transfer intellectual property rights in the product, its design, or related content.
Third-party names and trademarks belong to their respective owners. Their appearance does not, by itself, establish an affiliation or endorsement.
If you voluntarily submit a review, photograph, comment, or other content for publication, you retain ownership of that content.
You grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and reasonably format it as needed to publish the submission and operate or promote the Services, subject to our Privacy Policy and any consent required by law.
You must have the necessary rights to submitted content. Reviews should reflect your actual experience, and any compensation or incentive must be disclosed where required.
Submissions must not contain unlawful content, confidential information belonging to others, misleading claims, malware, or material that infringes another person’s rights.
We may remove submissions that violate these requirements. We will not alter a review in a way that misrepresents the customer’s experience.
This section does not treat private customer support messages or return documentation as permission to publish them.
The Services may include third-party payment options, tools, integrations, or links.
Your use of a separate third-party service may be subject to that provider’s terms and privacy notice. Please review those terms before using the service.
We do not control independently operated third-party websites. However, using third-party providers to support our store does not remove our own obligations concerning your purchase or personal information.
Shopify provides the technology platform hosting our store. Purchases made through Kodaga are transactions between you and Kodaga.
Kodaga is responsible for product information, order fulfillment, customer service, returns, refunds, and related sales obligations.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from your purchase transactions with Kodaga. This does not exclude any liability or obligation Shopify may independently have to you under applicable law or its own agreements.
Our Privacy Policy explains how personal information is collected, used, disclosed, and retained, together with available privacy rights and choices.
Because Shopify hosts our store, your device communicates with Shopify’s systems when you browse or shop. Shopify processes information about these interactions to provide, secure, and improve its services.
Shopify enhanced services may also use information about your interactions with Kodaga together with interactions involving other merchants and Shopify, including for personalization and advertising, subject to applicable privacy choices.
Information may be shared with Shopify and other service providers located outside your country of residence.
For details, review our Privacy Policy and the Shopify Consumer Privacy Policy. Available Shopify privacy choices can also be accessed through the Shopify Privacy Portal.
Accepting these Terms does not replace consent where separate consent is required for cookies, advertising, or other processing.
You must not use the Services to:
Violate applicable law or another person’s rights.
Submit fraudulent orders or use unauthorized payment information.
Impersonate another person or provide deliberately misleading information.
Harass, threaten, or abuse customers, staff, or other individuals.
Upload malware, attempt unauthorized access, or interfere with website security.
Collect other people’s personal information without a lawful basis.
Send spam or use the Services for phishing or other deceptive activity.
Copy or extract protected content for unauthorized commercial use.
Automated tools must not conceal their identity to bypass access restrictions, evade security controls, or interfere with the Services. We may restrict automated activity that creates a security risk, infringes rights, or disrupts normal operation.
Nothing in this section is intended to prevent lawful use of assistive technologies.
We may restrict access or suspend an account when reasonably necessary to address fraud, security risks, unlawful activity, or a material breach of these Terms.
Where appropriate and permitted, we will provide notice or an opportunity to resolve the issue.
Suspending access does not remove valid refund obligations, rights relating to existing orders, or other protections required by law.
Provisions intended by their nature to continue after termination remain effective, subject to applicable law.
We aim to keep the website available and functioning properly, but access may be interrupted by maintenance, technical problems, or events outside our reasonable control.
To the extent permitted by law, website features are provided on an “as available” basis.
This provision does not disclaim our responsibility to supply products as described, honor our published policies, or provide remedies required by law.
Nothing in these Terms excludes mandatory warranties, guarantees, or rights relating to defective, unsafe, incorrectly supplied, or misdescribed products.
To the extent permitted by applicable law, Kodaga is not responsible for indirect or consequential losses arising from use of the Services where those losses are legally excludable.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other matter to the extent that exclusion or limitation is prohibited by law.
These Terms do not remove your right to receive an eligible refund, obtain a remedy for a defective or incorrect product, or enforce other mandatory consumer rights.
To the extent permitted by applicable law, you may be responsible for reasonable losses and third-party claims directly caused by your fraud, unlawful conduct, or material violation of another person’s rights when using the Services.
You are not required by this section to compensate us or Shopify for losses caused by our or Shopify’s own negligence, misconduct, or breach of legal obligations.
Subject to mandatory consumer protection laws, these Terms are governed by applicable United States federal law and the laws of the State of Montana.
Please contact info@kodaga.com if you have a concern so we can attempt to resolve it.
Nothing in these Terms prevents you from contacting a regulator, exercising a lawful payment dispute right, bringing a claim in a court available to you under applicable law, or relying on mandatory protections in your place of residence.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms and the policies incorporated into them govern your use of the Services and purchases from Kodaga. They do not exclude legally binding statements or representations on which you are entitled to rely.
We may transfer these Terms as part of a legitimate business transfer, provided the transfer does not reduce your existing contractual or statutory rights.
Headings are included for convenience and do not change the meaning of the provisions.
If translated versions are offered, any difference will be resolved in accordance with applicable law. A translation provision will not remove protections applicable to your purchase.
We may send order confirmations, shipping updates, refund notices, account messages, and other service-related communications electronically using the contact details you provide.
Please keep your email address and other contact information current.
Promotional communications and related choices are addressed separately in our Privacy Policy. Placing an order does not, by itself, provide marketing consent where separate consent is required.
We may update these Terms to reflect changes in the Services, our operations, or applicable requirements.
We will publish the revised version on this page and update the “Last Updated” date. Where legally required, we will provide additional notice or obtain agreement.
Changes will not retrospectively reduce rights relating to orders already accepted. Those orders remain subject to the terms applicable when accepted, except where a change is required by law or agreed with you.
